Based on the findings of an onsite State Licensure Survey completed 2/06/2024, Angels On Call was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

(c) Prior to the commencement of services, the home care agency or home care registry shall provide to the consumer, the consumer's legal representative or responsible family member an information packet containing the following information in a form that is easily read and understood: (1) A listing of the available home care services that will be provided to the consumer by the direct care worker and the identity of the direct care worker who will provide the services. (2) The hours when those services will be provided. (3) Fees and total costs for those services on an hourly or weekly basis. (4) Who to contact at the Department for information about licensure requirements for a home care agency or home care registry and for compliance information about a particular home care agency or home care registry. (5) The Department's complaint Hot Line (1-800-254-5164) and the telephone number of the Ombudsman Program located with the local Area Agency on Aging (AAA). (6) The hiring and competency requirements applicable to direct care workers employed by the home care agency or referred by the home care registry. (7) A disclosure, in a format to be published by the Department in the Pennsylvania Bulletin by February 10, 2010, addressing the employee or independent contractor status of the direct care worker providing services to the consumer, and the resultant respective tax and insurance obligations and other responsibilities of the consumer and the home care agency or home care registry.

Observations:

Based on a review of consumer files (CF) and an interview with EMP1 & EMP2, prior to the commencement of services, the home care agency did not provide to the consumer, the consumer's legal representative or responsible family member an information packet containing who to contact at the Department for information about licensure requirements for a home care agency or home care registry and the telephone number of the Ombudsman Program located with the local Area Agency on Aging (AAA) for eight (8) of eight (8) consumer files reviewed (CF1 - CF8).

Findings include:

A review of CF's was conducted on 2/06/2024 between 10:30 a.m. and 12:30 p.m. The start of care (SOC) is indicated below:

CF1 SOC 2/02/2024. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF2 SOC 7/03/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF3 SOC 8/02/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF4 SOC 12/25/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF5 SOC 1/22/2024. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF6 SOC 12/21/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF7 SOC 8/14/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

CF8 SOC 10/10/2023. The "NOTICE OF PATIENTS RIGHTS AND RESPONSIBILITIES" listed the incorrect address for the Pennsylvania Department of Health and did not contain contact information for the Ombudsman Program located with the local Area Agency on Aging (AAA).

Interview with EMP1 and EMP2 on 2/06/2024 at approximately 2:30 p.m. confirmed findings.
























Plan of Correction:

Agency has a policy which is consistent with the regulation to provide the client and/or client's family on who to contact at the Department for information about licensure requirements for a home care agency or home care registry and for compliance information about a particular home care agency or home care registry. This includes the Department's complaint Hot Line (1-800-254-5164) and the telephone number of the Ombudsman Program located with the local Area Agency on Aging.

Agency will update the Notice of Patient's Rights and Responsibilities that is part of the client's intake paperwork with the Department's new address. The Ombudsman list will be updated to include all 67 Counties in PA with the Area Agency on Aging Ombudsman contact information.

On an annual basis, the Director of Quality & Compliance will review addresses to ensure no changes are required to the Department's information.

Once the intake packet is updated, new clients will receive the updated Ombudsman list. Current clients will be mailed an updated list for their information, which includes all 8 consumer files reviewed on 2/6/2024.

Based on the findings of an onsite State Licensure Survey completed 2/06/2024, Angels On Call was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
